Credit card surcharge laws in Mississippi (2026)
Allowed, card-network rules only
You can surcharge credit cards in Mississippi under card-network rules; the only state surcharge statute bars surcharging a state-issued government credit, procurement, travel, or fuel card, so do not surcharge Mississippi state agencies, universities, or school districts paying with a state p-card.
The details
| Debit and prepaid | No statute. Tracker claims that 'debit surcharging is illegal in Mississippi' refer to the card-network/Durbin rule, not Mississippi law. |

How this entry was checked
The official Mississippi Code is on a LexisNexis portal that is not searchable online, so the absence check used the Legislature's own sites and a general web search; hits were government-payment sections and dead bills (SB 2035 of 2020, SB 2856 of 2021). Narrow statute that does exist: Miss. Code Ann. 31-7-9(1)(d), read in the Legislature's own 2026 bill print of HB 1525 (unchanged paragraph; also present unmarked in SB 2591 of 2016): 'In a sale of goods or services, the seller shall not impose a surcharge on a buyer who uses a state-issued credit card, procurement card, travel card, or fuel card.' Enforced by the Department of Finance and Administration; no private cause of action. General deception rules of the Mississippi Consumer Protection Act (75-24-5) apply.
What this means for each program in Mississippi
| Surcharging | Allowed under the card-network rules below. No state cap or disclosure rule beyond those was found. |
|---|---|
| Cash discounting | Permitted under the card-network rules. The posted price is the card price and cash pays less; every card, debit included, pays the posted price. |
| Dual pricing | Treated like a cash discount in practice (our reading; no Mississippi statute addresses dual pricing): the card price shown first with the cash price beside it, every card pays the card price, cash pays the cash price. |
Card-network rules apply everywhere a surcharge is allowed
- Credit cards only. Never debit or prepaid, even when the customer presses "credit."
- Capped at 3% and never more than your own cost of accepting credit cards.
- Disclosed at the entrance and at the register, and printed as its own line on the receipt.
- Your processor (acquirer) gets written notice at least 30 days before you start.
